Terms of Hire / Contract Agreements

These terms apply to ALL contracts for installation
and/or Services,
labor only contracts and materials orders
for installation projects provided by Fastlink
(Fastlink Network Cabling Services)
Please read carefully that these terms and
conditions do not contain any items for which
you are not prepared to agree to
Installation and Labor Only Services:
All installation services are governed by
this agreement / policy.
All clients are required to SIGN a formal
installation agreement (contract acceptance)
prior to Fastlink performing any installation
services
for the protection of both parties involved.
ALL contracts will be clear as to the services
and or materials that will be provided.
This signed contract acceptance shall be
faxed to 1-866-852-9779
With the exception of CONTRACT CANCELLATION,
CHANGE ORDERS or ADDITIONAL WORK REQUESTS,
the client agrees that electronic mail (
EMAIL) will serve as an accepted means of
communication.
ALL verbal conversations MUST be confirmed
via email to become part of a contract or
the project itself, including
scheduling issues.
24 Hour Cancellation Policy:
ALL contract agreements can be cancelled
within 24 hours of Fastlink receiving a signed
contract acceptance
via FAX @ 1-866-852-9779 for a COMPLETE release
from the signed agreement
Time & Date stamp provided by our electronic
fax reception system provider , Efax.
This policy and the provisions of this policy
do not apply to installations that are scheduled
to begin within a 24 hour period of
the contract acceptance.
A written request to cancel the contract
agreement must be received via fax @ 1-866-852-9779
within 24 hours of original fax reception
of the signed acceptance.
A FULL refund of any deposit monies provided
by the client will be returned AFTER the
deposit check has been paid
by their banking institution and the funds
have become available for FASTLINK to withdraw.
Refunds will be made in GUARANTEED funds,
normally within 14 Days.
If a stop payment order has been placed on
any deposit check provided by the client,
the client agrees to pay a $100 fee to cover
bank fees that will be incurred by Fastlink.
Contract Cancellation AFTER 24 hour period:
After the 24 Hour cancellation period, an
installation or services contract can be
canceled by providing a
WRITTEN "Notice of Cancellation"
via FAX to 1-866-852-9779 .
There are NO EXCEPTIONS to this policy .
The written "Notice of Cancellation"
MUST contain the reason (s) for the cancellation.
A cancellation fee of 25% of the total contract
amount will be deducted from any deposit
monies received from the
client upon notification of the clients desire
to cancel the contract.
This fee is to cover time spent on the preparation
of the contract, site visits
and procurement of the required materials
to complete the project as outlined in the
"Scope of Work" of the installation
or services contract.
The 25% may be waived if the management of
Fastlink wishes to do so. Circumstances will
determine this policy.
In addition to the 25% cancellation fee,
the client will also be held responsible
for the cost incurred to ship,
return ship and all restocking fees
associated with the return of the materials
purchased
specifically for their installation or service
project from our vendors.
ALL materials are specially ordered for a
specific project. This includes cable, patch
panels, data jacks, etc.
Upon receipt of a "Notice of Cancellation"
from the contracted customer, Fastlink will
respond
within 14 days as to any and all fees that
will be associated with the contract cancellation.
All fees will be deducted from any deposit
received from the client. If a deposit
was NOT received, an invoice will be provided
to the client for prompt payment.
DELAY'S
Date Definite Installations are CLEARLY indicated
as such within the Installation Proposal
/ Contract in the "Special Notes"
section.
Contracts that do not include a specific
start date, will be scheduled based on current
work loads and the next available
date that allows for completion of the contracted
project from start to finish. Multiple phase
projects will be scheduled
according to availability at the time and
the needs of the client.
All scheduled installation or service contracts
are subject to delay and flexibility is required
on BOTH parties involved.
All projects will be completed within a reasonable
period of time.
Fastlink reserves the right to delay a project
in the event that scheduling conflicts occur.
Construction completion, lease negotiations,
real estate closings, material delays, office
painting ,among other common reasons,
are accepted
reasons for a delay of a cable installation
or cable termination ( or final termination
& testing of a ) project.
Based on information provided from the client
or an associated General Contractor (GC)
as to the status of a jobsite, Fastlink
will attempt to work out the most practical
time frame to complete the contracted work
as quickly as possible regardless of the
originally scheduled start date.
Please be aware that a delay caused by a
another scheduled project may effect the
scheduling of ALL projects.
We apologize for the inconvenience, however
we do our best to work around these types
of very common situations
MEDIATION:
In the event of a dispute, the client agrees
to seek resolution through private mediation.
